Barney Madsen Wins at the Utah Court of Appeals and Makes New Law

Barney Madsen, partner at Fillmore Spencer, won an appeal at the Utah Court of Appeals and made some new law. In Craig v. Provo City, the district court had dismissed Mr. Madsen’s case ruling that the State Savings Statute did not apply to the Governmental Immunity Act. The Court of Appeals reversed the district court’s ruling and stated expressly that the Saving Statute does in fact apply to the Governmental Immunity Act. The Court of Appeals reinstated the case and remanded it to the District Court for further proceedings.
