Before you file an insurance claim,
check to see if you have a personal injury case

Fillmore Spencer LLC’s personal injury attorneys in Provo help you determine whether the circumstances resulting in your serious injury — or in the death of a loved one — warrant a personal injury case. Many automatically file health insurance claims for treatment necessitated by serious or catastrophic injury, but when your injuries are the result of the criminal, reckless or inadvertent actions or neglect of others, it may be appropriate to bring a case.

Don't Go It Alone

About Our Personal Injury Practice

About Our
Personal Injury Practice

We work with individuals and families in personal injury claims involving motor vehicle accidents, medical malpractice, slips and falls, and other circumstances. It’s not required, but it’s always best if we are retained from the beginning, while evidence and witness recollections are freshest — we go over all aspects of your accident, so the more evidence and reliable testimony we have at our disposal, the better the prospects for your case.

Our Provo lawyers have won many personal injury cases with awards ranging from $100,000 to more than $1 million. We also help people whose injuries may not be permanently impairing but still need assistance to be treated fairly by insurance companies. Among the types of cases we most often handle are:

Car accidents

If you were injured due to the fault or negligence of another driver, we can help. There are also many other potential causes of a car accident, including road conditions at the time, the engineering design of the road, traffic management and signage, whether the other car was properly maintained, whether a pedestrian or third driver caused the first driver to seek evasive action that precipitated your serious injuries, and the integrity of the other car’s parts and braking, steering and other systems.

Trucking accidents

Trucking accidents tend to result in more severe injuries. And though they may be caused by many of the same factors that could lead to a car accident, there are additional factors to consider, including whether the driver’s qualifications were properly vetted by the company, whether the driver’s delivery schedule put the person more at risk of causing an accident and whether the truck was maintained and loaded properly.

Wrongful death awards

Those who survive a loved one’s wrongful death may be able to receive compensation if the death is the result of another’s negligence or reckless or intentional act. Examples of negligence would be drunk driving, distracted driving, drowsy driving or other unsafe conduct leading to the death of another. A reckless act would be drag racing or playing with a loaded handgun. An example of an intentional act would be murder.

"Where there is no accountability, there will also be no responsibility."

What Personal Injury Awards Cover

Personal injury case awards can cover much more than your current and future medical expenses. An award may also cover:
  • Time lost from work due to the injury, including time spent going to medical appointments or therapy
  • Any property that was damaged, such as your vehicle
  • The cost of hiring someone to do household chores that you can no longer do
  • Permanent disfigurement or disability
  • Emotional and physical pain and suffering
  • Any subsequent change in your future earning ability
At Fillmore Spencer LLC in Provo, personal injury clients are not charged attorney fees unless we win an award.

Utah personal injury threshold, statutes of limitations and award caps

In Utah, you cannot file a personal injury claim unless you either have reasonable and necessary medical bills of at least $3,000 or permanent disability and disfigurement. Also, you must file your claim within Utah statutes of limitations:

  • Personal injuries due to medical malpractice: Two years from the date first discovered
  • Personal injuries due to products liability: Two years from the date of occurrence
  • All other personal injuries: Four years from the date of occurrence
  • If the at fault party is in the scope of government employment: One year from the date of occurrence
